(1) Subscriptions

1.1 The Member shall pay a monthly membeship fee to The Unit Halifax. Monthly instalments will fall due on the same date of the month that they sign up on.

1.2 Membership fees shall be payable monthly in advance by standing order or annually in advance by a single payment. If paid annually the Member will be liable to pay the fee specified on the first day of membership.

1.3 The Unit Halifax shall be entitled to vary the membership fee and shall notify Members of such change not less than 2 months prior to such variation.

(2) Rules and Regulations

2.1 The Member agrees to abide by the rules and regulations stated in this Agreement and the Members Guide. The Company may alter the rules and regulations at any time; such alterations will be emailed to the member.

2.2 Members not complying with the rules and regulations may be asked to resign their Club membership.

(3) Facilities

3.1 A Member is entitled to use the facilities available under the relevant category of membership in accordance with the rules and regulations. The Unit Halifax reserves the right to add or to change the facilities from time to time. The Unit Halifax may also at any time withdraw part of such facilities for any period(s) where the same are required for other activities or in connection with any repair, alteration or maintenance work.

(4) Suspension of Membership

4.1 A Member may at any time apply in writing to The Unit Halifax to have his or her Membership suspended. Such suspension will be at the sole discretion of The Unit Halifax and will be considered where appropriate, in relation to medical or other unforeseen circumstances.

(5) Conduct

5.1 PHF has the right to prevent entry into the Club by anyone whose behaviour or appearance is deemed to be unsuitable.

5.2 Members must show consideration for one another in and around the Club, in particular profane or abusive language and the threat of use of violence will not be tolerated.

(6) Cancellation of Membership

6.1 The Unit Halifax reserves the right at any time, to cancel or suspend the membership of any Member where, in The Unit Halifax’s absolute discretion, there has been or is likely to be a breach of this Agreement or where any amount owed to The Unit Halifax by the Member has not been paid. In the event of such suspension or cancellation, no refund of joining fees or subscription will be made.

6.2 Any Member whose conduct shall be deemed by The Unit Halifax to be improper or likely to endanger the welfare, safety, harmony or good reputation of the Club, may be reprimanded or have his or her membership suspended or cancelled by The Unit Halifax. The Unit Halifax shall be the sole judge of what constitutes such conduct. In the event of such suspension or cancellation, no refund of joining fees or subscription will be made.

(7) Liability

7.1 The Unit Halifax liability for damage or loss to Members’ property is strictly limited to any damage or loss suffered as a result of the negligence of The Unit Halifax or its staff. With this exception The Unit Halifax will not accept liability for the safety of Members’ personal property brought on to the Club’s premises. Any lost property found must be immediately handed into the club reception and will be available for collection at normal opening hours.

7.2 Vehicles parked on the car park adjacent to the Club, and all contents within, are left at Members’ risk and The Unit Halifax will accept no liability whatsoever in respect of any loss or damage howsoever caused.

7.3 The Unit Halifax cannot accept liability for any accident or injury to any Member or child that may occur on the premises other than liability, which may arise from negligence of The Unit Halifax or its staff. Any member, person or child who suffers an accident or injury on the Club premises must report the accident or injury immediately to a member of staff.

7.4 Members should not undertake any physical activity for which they may not be fit and are responsible for monitoring their own condition during physical activity at the club. Should they experience any unusual symptoms they must stop the activity and inform a member of staff immediately. The Unit Halifax will not in any way be held responsible for any harm to a Member as a result of his or her undertaking any activity unless caused by negligence of The Unit Halifax or its staff.

7.5 The Club cannot accept any liability for the state of health of any member of any susceptibility. Members are required to notify the Club of any change in their health. All Members must have a fitness assessment. Any members who do not undertake a full induction/fitness test exercise at their own risk.

(8) Age Restriction

8.1 Participants under the age of 16 years may only take part in activities, programs, or services provided by The Unit Halifax if a parent/guardian is present or they give consent signing the official Waiver and Consent Form.

8.2 The Unit Halifax reserves the right to refuse participation if adequate supervision is not provided.

8.3 The parent/legal guardian accepts full responsibility for the Minor’s safety, behavior, and compliance with all rules.

8.4 The Unit Halifax is not responsible for any injury, loss, or damage resulting from the Minor’s participation unless caused by proven negligence on the part of The Unit Halifax.

8.5 Failure to comply with these terms will result in immediate suspension or termination of the Minor’s participation without refund.

(9) Variation of Agreement

9.1 The Unit Fitness shall be entitled to amend this Agreement at any time upon 2 months in writing.
